Rental regulations and cancellation policy

1. Rental of vacational accommodations are regulated by the Vacational Legislation currently in force in Malaga, namely Decree 75/2020 of 4th August.

2. The cost of the booking corresponds to 100% of the total rent. On collecting the keys, tenants must pay the amount of the rent pending, the security deposit and the Tourist Tax.

3. The right of occupancy of the rented dwelling starts at 4:00 pm on the day of arrival and finishes at 11:00 at am on the day of departure.

Keys will be collected at the property and/or, if fitting, a code to access the dwelling will be provided. Our opening hours during the tourist holiday season is 4:00 pm -10:00 pm. We kindly ask that you comply with this timetable so as to be able to assist you properly. It is advisable that you give us your approximate time of arrival.

In the event a client does not make the corresponding payment at the time the dwelling is booked, and/or if applicable, before the period of cancellation, in other words, 15 days before the date of the beginning of the stay, the company is not obliged to maintain said booking and may dispose of the accommodations for other possible tenants, unless the client notifies the company of a delay in respect to the time of arrival, and that the company accepts.

4. The security deposit will be refunded within a maximum of 7 calendar days following the client’s departure, once the accommodations have been checked, We will visit you between 9:00 and 10:00 am on the morning of departure to check the dwelling. If you are unable to be present for our visit, we kindly ask you to please return the keys before 11:00 am. Clients must leave the dwelling and its furniture in the same conditions in which they were on the day of their arrival. Likewise, the company and the client shall arrange for a visit by HIGUERON RENTALS S.L. before his/her departure from the property to check it and verify that it is in good conditions.

5. If any material or utensil should break during your stay in the apartment or house (for example cutlery, plates, glasses), we kindly ask you to replace it with the same material or utensil, or a similar one. If something of greater importance breaks, please inform the company, as it is possible to deduct the cost of the damages from the security deposit.

6. The amount of the rent does not include cleaning on the day of departure. We thus ask you to leave the dwelling clean, and in order. In case that is not possible, please let us know so that we can hire, on your account and at current rates, a cleaning service. Contracting said service cannot be a pretext for not leaving the dwelling in minimum conditions of cleanliness, with the kitchen material and utensils properly cleaned and put away in the correct place.

7. In the event that you wish to leave the dwelling before the agreed day and time, please let us know in order to arrange for a time and place to return the keys.

8. The rental price includes the usual consumption of supplies, such as water, electricity, gas and the Internet. In case consumption of these supplies is excessive, an extra surcharge may be applied to the client. Said surcharge can be deducted from the security deposit.

9. Pets are not allowed in dwellings, and the company does not authorise the entry of any animal or pet, regardless of the type of animal or species.

10. In dwellings that are part of a community of property owners, the community’s internal rules and regulations, Bylaws or established rules must be respected.

11. Tenants must respect the maximum capacity permitted in each accommodation. In a community of property owners with common areas (swimming pool, tennis court, gardens), these may only be used by persons staying in the dwelling.

12. No element or piece of furniture intended for the inside of the dwelling (indoor tables and chairs, sofas, electrical appliances, etc.) can be taken outside, with the exception of material or furniture intended for the terrace or garden.

13. In order to prevent the risk of theft, do not leave personal objects outside the dwelling (terraces and gardens), and carefully close all exterior openings, doors and windows when you leave the dwelling or when you are unable to control possible entries.

14. We ask you to kindly avoid making noise that could cause a nuisance to neighbours, in particular after 10:00 pm.

15. HIGUERON RENTALS S.L. is at your disposal to inform you and help you during your stay. We ask that in the event you should detect any anomaly, should there be a breakdown or should you have any complaint, please let us know immediately. We will try to solve the problem as soon as possible. However, HIGUERON RENTALS S.L. shall not be liable, under any circumstance, for any detriment caused by an external circumstance unrelated to the rented property. However, the company undertakes to make, at all times, necessary arrangements that are within its reach to resolve the problem, or at least to minimise it as much as possible.

CANCELLATION POLICY

Cancellation by the client of the booking shall give rise to the following penalties:

– If the cancellation is made 14 days prior to the booking’s date of arrival, the full amount of the booking (100%) will be refunded within 10 business days. If the cancellation is made less than 14 days in advance, the amounts previously paid will not be refunded.

– HIGUERÓN RENTALS S.L. will only refund 100% of the booking made in the event of a cause of Force Majeure.

– The commitment to rent does not include, on the agency’s part, any kind of insurance in connection with cancellation of the booking. The client may take out an insurance policy with the insurance company he/she wants, and with the clauses provided by the insurer.

Booking vacational accommodations implies acceptance by the client of the regulations contained in this document.
